Judge scolds MySpace lovers:

A Hamilton County judge Thursday lectured a man who had sex with a 13-year-old girl he met on an Internet social networking site, but included the victim in her warning about the dangers of meeting people online.

Hamilton County Common Pleas Judge Melba Marsh said that if the 19-year-old man and the girl, now 14, had listened to the girl’s mother, who tried to stop the relationship, neither would have had to step into a courtroom.

“(You both) seem to be operating without a brain,” Marsh said. “The one person trying to protect her daughter and protect you, neither of you paid any attention to.”

Marsh convicted the teen, who was 17 when he met the girl, on a misdemeanor charge of interfering with custody, dismissing two more serious charges of having unlawful sex with a minor.

At sentencing next month, he faces up to 180 days in jail.

n September 2005, the girl - who attends a West Side high school where she gets straight A’s - posted a picture of herself on MySpace.com in which the boy thought she looked older than 13.

The College Hill teen began chatting with her online, believing the girl was 16, according to testimony during Thursday’s trial.

The girl’s mother caught the couple in February, warning him that her daughter was 13 and he should leave her alone.

The affair didn’t end there. They saw each other at least two more times until the girl’s uncle caught the boy hiding in the girl’s house June 1.

Holding a bat, the uncle forced him to leave. That’s when the Hamilton County Sheriff’s Office was alerted. The teen was indicted Aug. 29.

Assistant Hamilton County Prosecutor Ryan Nelson said he is not a predator. “He just did something stupid.”
