Actor Joe Don Baker Sues Over MySpace Posting:
Joe Dan Baker, who starred in the 1973 classic Walking Tall, is suing an unnamed defendant over a fake MySpace�

Baker filed his lawsuit Tuesday in Los Angeles Superior Court, claiming infringement of right of publicity and misappropriation of likeness. It asks for unspecified general, special and punitive damages.

The defendant is named in the lawsuit as “John Doe” because Baker does not yet know who is responsible for the posting, according to Baker’s court papers.

The posting was created on myspace.com Sept. 7 and states, “I am Joe Don Baker,” the lawsuit stated. The posting also states both true and false background information about the actor’s marital status, sexual orientation, ethnicity, religion, zodiac sign, income and educational history, among other details, according to the lawsuit.

Other myspace.com visitors sent emails to the posting creator thinking they were communicating with the actor, the lawsuit stated.

“In fact, (Baker) had nothing to do with the Web site,” the lawsuit stated. Baker found out about the posting on or about Nov. 21 and complained to myspace.com operators, who removed it Nov. 25, the lawsuit stated.

“John Doe” better be careful or Joe Dan might take out his litigation with a Tennessee Toothpick.
