City officials respond to fired police officer’s appeal:
When we last left our story fired Lexington, Kentucky police officer Joshua Cromer was appealing his termination from the Lexington PD. If you recall Cromer was fired for inappropriate use of his MySpace concerning the drunk driving arrest of country singer John Michael Montgomery.
Cromer appealed the city council’s decision to fire him last month; he alleged several missteps by the city council, including Mayor Jim Newberry’s not allowing council members to be examined for potential bias before the hearing.
In the response, city attorneys deny those allegations. They also state that Cromer misled police officials about his work status when they interviewed him in September as part of an investigation into Montgomery’s arrest. Cromer and his attorney maintain that he was on medical leave during the investigation and should not have been questioned.
Cromer had been relieved from duty since March 29, 2006, but was not officially suspended until Oct. 10 and was not formally charged until later. Cromer’s attorney has argued that police failed to hold a hearing within 60 days of Cromer’s suspension as required by state statute.
In their response, city attorneys deny Cromer’s case was improperly handled but do not offer a counter-argument.
