Plea deal nixed after party pics
Plea deal is off after accused seen partying:
17-year-old Michael Ramirez of New Hampshire was charged with two counts of vehicular assault after speeding, losing control of his car and slamming headlong into an SUV. His passenger, 16-year-old Nathan Hergenhahn, died at the scene. Prosecutors had reached a plea agreement. However pictures of Ramirez partying on MySpace have surfaced and the plea has been withdrawn.
Under the plea deal, Ramirez would have received a deferred sentence, seven years’ loss of license and 1,032 hours of community service, Shepherd said.
Earlier this month, Judge William Groff rejected the plea bargain and it was going to be resubmitted yesterday. Instead, the prosecution withdrew the plea bargain after receiving input from Hergenhahn’s family.
The family, which had originally been in favor of the plea bargain, withdrew its support after seeing the photographs depicting Ramirez at a party on Myspace.com.
“The family thought he was remorseful,” Shepherd said. “Obviously the family is just devastated. They’re grieving and then they saw those photos.”
Even with a trial the most he is looking at is one year behind bars.
