Fake MySpace leads to expulsion, lawsuit

Teen MySpace Hoaxer’s Lament:
An unnamed 13-year-old from Ohio was expelled from Hillside Middle School in Parma, Ohio after he created a fake MySpace of Hillside Middle School Principal Jeff Cook.

The MySpace profile, which was headlined “Your Princeypal,” did not carry Cook’s name, but it included his photo and identified him as the Hillside Middle School principal. The since-removed profile, an excerpt of which you’ll find below, listed Cook’s general interests as “giving students anal” and “jacking off in my office,” and named his heroes as Michael Jackson, Adolph Hitler, and Saddam Hussein.

Rather than the parents being appalled at their precious little snowflake’s behavior Toader and Marianna Osan are suing the school saying the expulsion violated his right to free speech.

How many times do we have to go through this? Libel is not protected under the First Amendment. Secondly his free speech was violated because he wasn’t arrested for his act. And lastly freedom of speech doesn’t protect you from the repercussions of those actions.

If this was my son the closest he’d be coming to a computer would be a Matell See and Say.

    Trench, when are you going to post the results of this lawsuit? Why is it CNN/Headlines News beat you to it? Is it because you wish to discourage people to file lawsuits against abusive, power-tripping school administrators? I would appreciate it very much if you were as forthcoming with the outcomes of those successful lawsuits, as you are so quick to discourage legitimate victims from filing them in the first place. Anyways, CNN/Headline News reported though anchorman Mike Galanos, last Saturday, February 23, 2008, that the boy’s parents were very successful with their lawsuit, on top of having their 13 year-old reinstated, they also received a very large financial settlement for the violation of their son’s First Amendment Rights, in spite of your stupid rants against them. Could you please report it ASAP on this page as a follow-up. Thank you. I still do appreciate your work nevertheless.

    Don’t forget the dumbass lady who spilled McDonalds coffee in her lap was also awarded a settlement.

    please provide a link to the settlement of the lawsuit; I have checked CNN and have found nothing.

    and remember, the woman who won the suit at McDonalds had been given a liquid that was hot enough to take the skin off her legs and require skin grafts; what do you think a sip of that would have done to the inside of her mouth? Also, McDs had been warned to lower the temperature on their hot drinks several time before, and obviously ignored it.

    She would have taken a small sip and gone “ooh that’s too hot” and she would have let it cool down if she had sense.

    It would be interesting to see these parent’s reaction if someone made them a Myspace page about their love of threesomes with barnyard animals….free speech, you know!

    On the free speech issue- he was free to post it, however since he defamed the name/image of another person, no matter how young he is he should still be held liable.

    any who think otherwise, think about this, how would you like it if all of a sudden you found a myspace page about you that claimed you to be gay, love little children, and have adolf hitler as one of your heroes?
